According to VA Code § 18.2-61, Rape is defined as engaging in sexual intercourse with any other person, regardless if there is an existing spousal relationship, and it's:

  • against the person's will, by the use of force, threat or intimidation;
  • or if the person is mentally incapable or physically helpless and cannot give consent; or
  • with a child under age 13 as the victim.
